Terms of Service
How we work together.

1. Who these terms are between
These Terms of Service govern the agreement between you (the “Client”) and Made by Monday, a division of Beacon Labs (“Made by Monday,” “we,” “us”), a Canadian company. By submitting an intake form, paying a deposit, or using our services, you agree to these terms.
2. Services
Made by Monday offers two service categories:
- Website builds. One-week, flat-fee, custom-coded websites delivered against the package tier you select (Starter, Standard, or Premium). Scope, included pages, and revision count are defined per package.
- Care plans. Optional monthly hosting, updates, and small-change service after launch (Lite, Care, or Care+). Month-to-month with no long-term commitment.
The complete scope for each engagement is confirmed in writing during the kickoff call and recorded in the project intake record.
3. Pricing and payment
Package prices are listed in Canadian dollars (CAD) and are subject to applicable Canadian taxes (HST/GST where applicable). Payment options are:
- Pay in full. Full package price due before kickoff. No further build invoicing.
- 50% deposit. Half due before kickoff, the remaining half invoiced upon launch (typically Day 7) and payable within 7 days.
Payments are processed through Stripe. We do not store card data. Care plan subscriptions, if elected, begin on the launch date and are billed monthly thereafter.
4. Refunds and cancellation
We aim to be fair. The following policies apply to build projects:
- Before kickoff. Full refund of any deposit paid, less any non-refundable third-party fees (e.g. Stripe processing fees, which Stripe does not return).
- After kickoff, before Day 4. Deposit retained to cover discovery, design time, and project scheduling. Any additional amounts paid above the deposit are refunded.
- After Day 4. No refunds. The build is substantially underway and resources are committed.
Care plans can be cancelled at any time with 30 days’ notice; no further charges after the notice period.
5. What you provide
The one-week timeline depends on prompt collaboration from you. You agree to:
- Provide content (text, photos, logos, brand assets) within the timeframes set at kickoff
- Respond to design and revision requests within one business day
- Provide accurate information and necessary access (domain, existing accounts, integrations) when requested
If material content or feedback is delayed beyond agreed timeframes, the launch date may be moved by mutual agreement. Significant delays (more than one week past kickoff) may incur a re-scheduling fee or require a new agreement.
6. Ownership
Once the build is paid in full, you own:
- The final website code we deliver to you
- The content you provided
- Any custom designs created specifically for your brand
We retain ownership of any pre-existing components, frameworks, utility code, or design patterns we use across projects, and the right to reuse them. We also retain the right to display your completed website in our portfolio (including on /work) and in marketing materials, unless you ask us in writing not to.
7. Warranty
For 30 days after launch, we will fix any genuine bug introduced during our build at no charge. This warranty does not cover:
- Changes to scope or new features
- Issues caused by changes you or third parties made after launch
- Third-party service failures (hosting, payments, email, etc.)
- Browser compatibility for browsers that we did not test against at delivery
A Care plan extends this coverage indefinitely and includes proactive monitoring, hosting, and small content changes.
8. Limitation of liability
To the maximum extent permitted by law, our total liability to you for any claim arising from the services is limited to the amount you have paid us in the preceding 12 months. We are not liable for indirect, incidental, or consequential damages, or for lost profits, lost data, or business interruption.
9. Confidentiality
We treat your business plans, customer data, and strategic information as confidential. We do not share them outside our team or with third parties except where required to deliver the services (e.g. with hosting providers) or as required by law.
10. Termination
Either party may terminate a build engagement for material breach with 7 days’ written notice and opportunity to cure. On termination, you receive the work product completed to the termination date in exchange for payment proportional to the work completed (subject to the refund policy above).
11. Governing law
These terms are governed by the laws of Canada and the province in which Beacon Labs is incorporated. Any disputes will be resolved in the courts of that jurisdiction.
12. Changes
We may update these terms occasionally. Active client engagements continue under the version of terms in effect when their build was booked. For care plan subscriptions, material changes will be communicated at least 30 days in advance.
